CYCLE PARKING COMPETITION TERMS AND CONDITIONS

1. These terms and conditions are the Competition Rules ("Rules") and apply to the competition for submitted ideas for cycle parking on the Pegasus Theatre site ("the Competition"). By entering the Competition, entrants agree to be bound by these Rules.

2. The Competition is organised by Pegasus Theatre Trust Limited, a registered charity and company limited by guarantee (number), (“Pegasus Theatre”), registered address 7 Newtec Place, Magdalen Road, Oxford, OX4 1RE.

3. These Rules are specific to the Competition and do not refer to any other similar activity operated by Pegasus Theatre at any time now or in the future, or as may from time to time be established for any reason.

4. Pegasus Theatre reserves the right to cancel or amend the Competition or the Rules without notice in the case of any event outside Pegasus Theatre's reasonable control. Any changes will be posted either within these terms and conditions. A copy of the Rules may also be obtained by sending a stamped addressed envelope to: Competition Rules, Pegasus Theatre, 7 Newtec Place, Magdalen Road, Oxford, OX4 1RE.

5. In the event of any dispute regarding the Rules, conduct, results and all other matters relating to the Competition, the decision of Pegasus Theatre shall be final and no correspondence or discussion shall be entered into.

Qualifying Entrants

6. Pegasus Theatre reserves the right not to award a prize (and to select an alterative winner) if Pegasus Theatre is aware or has reasonable grounds to believe that a winner is not eligible for any or all of the reasons below.

7. Entrants to the Competition must not be under 6 years of age, nor over 19 years of age, on the closing date, 8 February 2010. This must be verified by signature of a parent, guardian, regular carer, or, in the case of group entries, an adult in a suitable supervisory capacity (eg teacher, youth group leader). If a group entry, all members of the entering group must satisfy these age requirement. Pegasus Theatre reserves the right to request documentary evidence of age.

8. By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. Pegasus Theatre reserves the right to verify the eligibility of all entrants.

9. The address you provide with your competition entry ("Entry") will be used to send any prizes so please make sure this is correct. The Competition is only open to residents of the United Kingdom and you are not entitled to enter the Competition if you are resident outside of the United Kingdom.

10. Pegasus Theatre reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.

11. In the event that any entrant is disqualified from the Competition, Pegasus Theatre in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.


Competition Entries

12. You may enter the Competition as many times as you like, subject to these Rules.

13. The Closing Date of the competition is 8 February 2009. Pegasus Theatre must have received qualifying entries by 5pm on this day, in hard copy only, at its office at 7 Newtec Place, Magdalen Road, Oxford, OX4 1RE. Receipt of entries will not be given unless a stamped, self addressed envelope is provided.

14. Competition entries must be made in the manner and by the closing date and time specified on the Competition Notice. Failure to do so will disqualify the entry.

15. There is no purchase requirement to enter a Competition and there is no charge to enter.

16. Proof of posting or emailing cannot be accepted as proof of delivery. Pegasus Theatre cannot accept responsibility for any error, omission, or Entries lost, damaged or delayed for any reason outside Pegasus Theatre’s control.

17. Entrants should note that Pegasus Theatre does not accept responsibility for the return of any Entries.

Prize

18. One winner will be selected by the Judging Panel after the Closing Date. The prize will be for the winner to work with our commissioned artist Matthew Lane Sanderson (the Artist) to see the ideas generated be developed into a practical sculptural installation for permanent cycle parking. The installation will be part of the new Pegasus Theatre building. The winner, with the Artist, will be credited permanently as the creators of the installation.

19. Members of the judging panel will be announced on the website at a later date.

20. The prize winner will be contacted after the Closing Date by Pegasus Theatre. The winner’s name may be published on the website.

22. The prize is non-transferable and there is no cash alternative.

23. Pegasus Theatre and/or the Competition judges (acting reasonably) reserve the right not to select a winner, and/or to remove or amend selection criteria and/or the structure and operation of the Competition if Entries are not of the requisite standard.

Intellectual Property Rights & Use of Entries

26. Pegasus Theatre will not seek a right of ownership in your Entry. As such, you retain ownership of your Entry but you will, by entering, agree that if you win to allow development, with you, of the ideas into a practical artistic installation. You will share joint rights of the final installation with Pegasus Theatre and artist Matthew Lane Sanderson, and will be credited as such as part of your prize.

27. In consideration of Pegasus Theatre agreeing to consider entrants to the Competition, each entrant hereby agrees that Pegasus Theatre (and third parties authorised by Pegasus Theatre) may make any and all Entries available on the website and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television and/or radio and that Entries may be made available with advertising and/or sponsorship. You now grant Pegasus Theatre (and third parties authorised by Pegasus Theatre) a non-exclusive, worldwide, irrevocable licence (for the full period of any rights in the Entry) to use, display, publish, transmit, copy, make derivative works or podcasts from, edit, alter, store, re-format, sell and sub-licence the Entry for such purposes.

28. Pegasus Theatre does not guarantee to use or otherwise make available any Entry. Pegasus Theatre may also, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.

29. Your Entry and any information submitted by you must be personal to and relate specifically to you, or, in the cases of group entry, all members of the group as if one body. You hereby warrant that your Entry and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. If relevant, Pegasus Theatre reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.

Liability

30. Pegasus Theatre cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize. Pegasus Theatre is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Competition. Nothing shall exclude Pegasus Theatre’s liability for death or personal injury as a result of its negligence.

Data Protection and Publicity

31. Winners may be requested to take part in promotional activity and Pegasus Theatre reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity.

32. Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent. Please see Pegasus Theatre’s privacy policy for further details. Data relating to entrants will be retained by Pegasus Theatre for a reasonable period after the Competition closes to assist Pegasus Theatre to operate competitions in a consistent manner and to deal with any queries on the Competition.

Jurisdiction

33. The Competition and Rules will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England. The Sites are only intended to be accessed from the United Kingdom. Pegasus Theatre makes no representation that materials on the Site relating to this Competition are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. If you access the Site outside of the United Kingdom, you are responsible for compliance with all local laws.
